These Terms of Service apply to purchases made from The Tomato Patch, including through our website, by message, or in person.
By placing an order with us, you agree to these terms.
About us
The Tomato Patch is a small front-yard nursery based in Bomaderry, NSW. We sell potted roses, seasonal plants and related nursery products for local pickup and, where available, local delivery.
Products and availability
We do our best to keep product listings, prices, descriptions and availability accurate. However, as we sell live plants, stock can change quickly.
Plants may vary in size, shape, flowering stage, foliage, pruning stage and appearance depending on the season. Product photos may show mature plants, flowers or examples of the variety and may not represent the exact plant supplied.
If a product becomes unavailable after you order, we will contact you to offer a suitable replacement, store credit or refund.
Prices
All prices are in Australian dollars. Prices may change at any time without notice.
Any delivery fees, if applicable, will be shown at checkout or confirmed before delivery.
Orders and payment
Orders are confirmed once payment has been received.
We reserve the right to refuse or cancel an order if there is an error in pricing, stock availability, delivery details, suspected fraud, or another reasonable issue affecting our ability to complete the order.
Pickup
Pickup is from our front-yard nursery in Bomaderry by appointment unless an open day is advertised.
Please wait for confirmation that your order is ready before coming to collect. If you need to change your pickup time, please contact us as early as possible.
Local delivery
Local delivery may be available to selected Bomaderry, Nowra and Shoalhaven areas.
Delivery availability, timing and fees may vary depending on location, order size and our schedule. We may decline delivery if the address is outside our delivery area or unsuitable for safe delivery.
If no one is home, we may leave the order in a safe, shaded place if available. Once delivered, the plants become the customer’s responsibility.
Plant care
We provide plants in good faith and aim to supply healthy, clearly labelled stock. After pickup or delivery, plant care is the customer’s responsibility.
Live plants require appropriate watering, sunlight, drainage, soil, planting, pruning, pest control and weather protection. We are happy to offer general care advice, but we cannot guarantee results in every garden or growing situation.
Intellectual property and plant breeder rights
Some roses and plants may be protected by Plant Breeder’s Rights, trademarks or other intellectual property rights. Purchase of a plant does not give the customer the right to commercially propagate, reproduce, sell or distribute protected plant material unless they have the required permission from the rights holder.
Website information
Information on our website is provided for general gardening and product information only. While we aim to be accurate, growing conditions vary between gardens and seasons.
We are not responsible for loss or damage resulting from reliance on general gardening information where local conditions, care practices or other factors affect plant performance.
Limitation of liability
To the extent permitted by law, The Tomato Patch is not liable for indirect, incidental or consequential loss arising from the purchase, planting or care of live plants.
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.
Changes to these terms
We may update these Terms of Service from time to time. The current version will be available on our website.
